Sampling in Music Production: Creativity or Criminality?
I am interested in exploring the topic of sampling in music production and whether it should be considered a creative art form or a form of plagiarism. Sampling is the incorporation of a short segment of a sound recording into a new recording. It is commonly used in hip hop, electronic, and experimental music. As someone who enjoys electronic music, I find the use of sampling to create new music from old sounds to be really intriguing. However, sampling also raises legal and ethical questions about creative ownership and plagiarism that I would like to explore in more depth.
Sources:

A chapter focuses specifically on sampling and the legal issues around incorporating copyrighted works into new creative works.
3. Demers, J. (2006). Steal this music: How intellectual property law affects musical creativity. University of Georgia Press.
This book investigates how copyright law has impacted music, specifically looking at the growth of sampling. It includes interviews with music producers and examples of legal challenges around well-known songs that incorporate sampling. It provides an argument for how overly restrictive copyright laws can stifle creativity.
